Welcome to 3choAfrika by Eycube. These Terms of Service ("Terms") dictate the rules and guidelines for using our website, accessing the Growth Dashboard, and engaging with our digital growth intelligence platform and creative marketing services.

By accessing or using our website, Growth Dashboard, or services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use our services.

3choAfrika is a specialized digital growth intelligence platform designed for African brands, operated by Eycube. We provide strategy audits, marketing analytics via our Growth Dashboard, and end-to-end creative marketing execution.

We grant you a limited, non-exclusive, non-transferable, and revocable license to use our website for your personal, non-commercial use, subject to your compliance with these Terms.

Access to the Growth Dashboard is provided as a premium, subscription-based, or service-bundled software product. Use of the dashboard requires an active account, and we reserve the right to restrict access if usage violates these Terms or subscription agreements.

To access certain features, you must create an account. You are responsible for safeguarding your login credentials and for any activity that occurs under your account. You must notify us immediately of any unauthorized use or security breach.

When engaging with 3choAfrika for audits or execution services, clients are responsible for providing accurate business information, timely access to required advertising or analytics platforms, and necessary approvals to ensure the successful delivery of services.

Specific service engagements (e.g., executing a Growth Roadmap or media buying) will be governed by a separate Master Services Agreement (MSA) or Scope of Work (SOW) which outlines deliverables, timelines, and fees. In the event of a conflict, the SOW supersedes these Terms.

Fees for the Growth Dashboard, strategy audits, and execution services will be detailed in your proposal or subscription page. All payments are non-refundable unless otherwise explicitly stated in writing. We reserve the right to suspend services for overdue payments.

The 3choAfrika platform, website design, graphics, software code, logos, and original content are the intellectual property of Eycube. You may not copy, modify, distribute, or reverse-engineer our intellectual property without written permission.

You retain ownership of any logos, brand assets, and proprietary data you provide to us. By providing these materials, you grant us a limited license to use, host, and display them solely for the purpose of providing services to you.

You agree not to use the website or Growth Dashboard to:

• Violate any local, national, or international law.
• Transmit any malicious code, viruses, or harmful software.
• Attempt to gain unauthorized access to our systems or other users' accounts.
• Scrape, harvest, or extract data from our platforms using automated tools.

Our dashboard integrates with third-party platforms (e.g., Meta, Google). Your use of those integrations is subject to the terms and privacy policies of those third-party providers. We are not responsible for changes made by third-party APIs that may affect dashboard functionality.

While we strive for accuracy, digital tracking and analytics are subject to limitations caused by browser privacy settings, ad blockers, and third-party platform attribution models. 3choAfrika provides data "as is" and does not guarantee the absolute accuracy of aggregated metrics.

Both parties agree to keep any proprietary business information, strategy documents, and financial data exchanged during the course of our relationship strictly confidential, except where disclosure is required by law.

THE SERVICES ARE PROVIDED ON AN "AS-IS" AND "AS AVAILABLE" BASIS. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL EYCUBE OR 3CHOAFRIKA BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, OR DATA.

We may terminate or suspend your access to our services immediately, without prior notice, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the services will immediately cease.

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
